This page states the Terms and Conditions (“Terms”) under which you (“You”) may use the Joblooba Website and the Services we provide. This www.joblooba.com (the “Website”) is owned and operated by Joblooba Limited (the “Company” “we” “us”, or “Joblooba”).

These Terms constitute a binding agreement between You and Joblooba Limited, and are deemed accepted by You each time that You use or access the Joblooba Website or the Services we provide. If You do not accept the Terms stated here, do not use the Joblooba Website and/or our Services.

The Website is made available for use by individuals seeking employment openings, by individuals and/ or organisations seeking to make available information regarding employment openings, on their behalf or other’s behalf. If you are accessing or using the Website in your capacity as an employee or other representative of an Employer, you are agreeing to the Terms on behalf yourself and such Employer, as applicable, and you represent and warrant that you have authority to bind such Employer, to these Terms.

The Joblooba Website allows users (“Candidates”) to create individual profiles, which may include personal information (“Profiles”), and to make these Profiles, or aspects public.

Those users who violate these Terms may have their access and use of the Joblooba Website suspended or terminated, at Joblooba’s discretion.

1. Changes To These Terms

Joblooba may revise these Terms at any time by updating this page. You should visit this page periodically to review the most current Terms.

2. Changes To Our Website

We may correct any error appearing in the Website or withdraw any products from sale without incurring liability. Price is also subject to change without notice.

From time to time we may update our Website, and may change the content at any time. However, please note that any of the content on our Website may be out of date at any given time, and we are under no obligation to update it.

We cannot guarantee that our Website, or any content on it, will be free from errors.

3. Accessing Our Website

Our Website is made available free of charge.

Joblooba does not guarantee that our Website, or any content on it, will always be available. Access to our Website is permitted on a temporary basis. We may suspend, withdraw or change all or any part of our Website without notice. We will not be liable to you if for any reason our Website is unavailable at any time or for any period.

You are responsible for ensuring that all persons who access our Website through your internet connection are aware of these Terms, and that they comply with them.

We may limit the availability of our Website or any service or product described on our Website to any person or geographic area at any time.

4. Joblooba

a) “Joblooba” is the trademark or registered trademark of Joblooba Limited and/or our affiliates in the U.K. and in other countries.

b) The material on the Website is copyright to Joblooba Limited. You may view, print and download the contents of the Website for personal use, but not for any commercial purposes or re-publication. The content of the Joblooba Website, including, but not limited to, designs, logos, text, images, videos and other content, are protected under copyright and trademark and other laws.

5. Use Of Joblooba Services

The job posting, resume database and other features of the Joblooba Website may be used only by individuals who are seeking employment and/or career information and by recruiters seeking employees. Additionally, Joblooba Profiles may be used by individuals for professional and personal networking purposes.

The following Terms apply to all Candidates, Employers, Publishers and other users who access or use the Website, or otherwise indicate their acceptance to these Terms.

The term ‘post’ herein shall mean information that You submit, publish or display on the Joblooba Website.

Terms Applicable To All Joblooba Users

You may use our Website only for lawful purposes. You may not use our Website:

  • To transmit, post, store or destroy material, including without limitation Joblooba Content, in any way that breaches any applicable local, national or international law or regulation, including but not limited to laws or regulations governing the collection, processing, or transfer of personal information or in breach of  Joblooba’s Privacy Policy;
  • In any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect;
  • To take any action that imposes an unreasonable or disproportionately large load on our Website’s infrastructure;
  • For the purpose of harming or attempting to harm minors in any way;
  • To violate or attempt to violate the security of the Website including attempting to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without proper authorisation;
  • To aggregate, copy or duplicate in any manner any of the Website’s content, other than as permitted by these Terms.
  • To post any content or material that promotes or endorses false or misleading information or illegal activities, or endorses or provides instructional information about illegal activities or other activities prohibited by these Terms;
  • To send, knowingly receive, post, upload, download, use or re-use any material which does not comply with these Terms.
  • To post any Resume or Profile, or apply for any job on behalf of another party;
  • To defer any contact from an employer to any agent, agency, or third party;
  • To access data that is not intended for You or logging into a server or account which You are not authorised to access;
  • To transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any form of similar solicitation (spam);
  • To post or submit to the Website any incomplete, false or inaccurate biographical information or information which is not your own;
  • To post content that contains access pages, hidden pages or images;
  • To solicit password or personally identifiable information from other Users;
  • To harass, incite harassment or advocate harassment of any group, company or individual using our Website;
  • To attempt to interfere with service to any User, host or network, including, without limitation, transmitting data, sending or uploading any material that contains viruses, Trojan Horses, worms, time bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware.
  • To promote or endorse an illegal or unauthorised copy of another user’s work.
  • To use Joblooba Services for any unlawful purpose or any illegal activity, or post or submit content, Resume, or job posting that is defamatory, libellous, implicitly or explicitly offense, vulgar, obscene, threatening, abusive, hateful, racist, discriminatory, of a menacing character or likely to cause annoyance, inconvenience, embarrassment, anxiety or could cause harassment to any person or include any links to pornographic, indecent or sexually explicit material of any kind, as determined by Joblooba’s discretion; or
  • To post any material including but not limited to resumes or jobs which is not genuine or any material which attempts to advertise or promote products or services.

Violations of our system or network security may result in civil and/or criminal liability. Joblooba will investigate occurrences which may involve such violations and may involve, and cooperate with, law enforcement authorities in prosecuting Users who are involved in such violations.

Job Postings

Joblooba may make available certain job postings and other job-related content, including links to third-party websites, through Joblooba’s search results or otherwise through the Website. Job listings are created and provided by third parties over whom we exercise no control; you acknowledge and understand that we have no control over Job Postings. Joblooba does not have any obligation to screen any Job Posting, or to include any Job Posting in its search results or other postings, and may exclude or remove any Job Posting from the Website for any or no reason without incurring liability. We cannot confirm the accuracy or completeness of any Job Posting or other information that has been submitted by any employer or other user, including the identity of such employer or other user. Joblooba assumes no responsibility, and disclaims all liability, for the content, accuracy, completeness, legality, or availability of any Job Posting.

You may not use Your Joblooba Job Posting or Joblooba to:

a) Post in a manner that does not comply with local, national and international laws, including but not limited to laws relating to labour and employment, equal employment opportunity, data privacy, data access and use.

b) Post material that is false, misleading, discriminatory, threatening, offensive, abusive, obscene, hateful, inflammatory, encourages violence or racial or religious hatred, blasphemous, pornographic or sexually explicit, in breach of confidence, in breach of privacy;

c) Determine a user’s eligibility for: i) credit or insurance for personal, family, or household purposes; ii) employment; or  iii) a government license or benefit;

d) Promote material which is defamatory of any person;

e) Promote discrimination based on race, sex, religion, nationality, disability, sexual orientation or age;

f) Infringe any intellectual property rights, such as copyright and trademarks. This means You must own the rights or obtain permission from the rights owner before submitting material to the Website;

g) Post Jobs or otherwise advertisement for competitors of Joblooba or post jobs or contain links to any website in competition with Joblooba;

h) Sell, promote or advertise products or services;

i) Promote any opportunity that does not represent bona fide employment;

j) Advertise sexual services or seek employees for jobs of a sexual nature;

k) Request the use of human body parts or the donation of human parts, including, without limitation, reproductive services such as egg donation and surrogacy;

l) Endorse a particular political party, political agenda, political position or issue; and

m) Except where allowed by applicable law, post jobs which require the applicant to provide information relating to his/her i) racial or ethnic origin ii) politician beliefs iii) religious beliefs iv) physical or mental health or v) the commission of criminal offences or proceedings;

We will not be responsible, or liable to any third party, for the content or accuracy of any materials submitted by You.

You may not use Your Joblooba Resume Posting to:

a) Post in a manner that does not comply with local, national and international laws, including but not limited to laws relating to labour and employment, equal employment opportunity, data privacy, data access and use.

b) Post material that is false, misleading, discriminatory, threatening, offensive, abusive, obscene, hateful, inflammatory, encourages violence or racial or religious hatred, blasphemous, pornographic or sexually explicit, in breach of confidence, in breach of privacy;

We will not be responsible, or liable to any third party, for the content or accuracy of any materials submitted by You.

If You are a Job Seeker, any resume or application information that You submit through the Website is subject to these Terms and to Joblooba’s Privacy Policy. By creating a Joblooba Resume through our Website, you are requesting and authorising Joblooba to make available your resume to any Employer that Joblooba believes may have an interest in your resume. Additionally, when you indicate your interest in a Job Listing through Apply Now or Apply via LinkedIn you are sending your resume and application information to Joblooba, and requesting and authorising Joblooba to make available that information to the applicable Employer(s) for such Job Listing(s). When you ask Joblooba to transmit an application to an Employer via Apply Now or Apply via LinkedIn, you understand that this is without warranty. Joblooba does not guarantee that any Employer will receive, access, read or respond to any such resume or application material, or that there will be no mistakes in the transmission of the data. By using Apply Now or Apply via LinkedIn , you agree that Joblooba is not responsible for the content of the Employer’s application form, screener questions or its format and that Joblooba does not guarantee receipt of your application by the Employer. You consent to your application and any responses sent to you by the Employer (including offer letters) through Joblooba being processed and analysed by Joblooba according to these Terms and Joblooba’s Privacy Policy. Joblooba does not guarantee the validity of a job offer and cautions Job Seekers to verify the validity of a job offer before taking an adverse action regarding their current employment.

If you are an Employer, when you create an Account or post a Job Listing on the Website, you agree that these Terms and all of Joblooba’s policies including the Privacy Policy and Cookie Policy, apply to you and to the Job Seekers indicating an interest in such Job Listings. You agree that the Apply Now or Apply via LinkedIn is presented to you without warranty and Joblooba assumes no responsibility for the communications between you and the Job Seeker which are yours’ and the Job Seeker’s sole responsibility. You are responsible for the contents of any Account or Job Listing that you create or post and any messages that you send through Joblooba or Listings that you post, and any messages that you send through the Website or otherwise including any questions for Job Seekers. You shall indemnify, defend and hold harmless Joblooba, its agents, affiliates, and licensors from any third-party claim or liability (including without limitation reasonable legal fees) arising out of any Account created by you, or any Job Listing posted by you, or any message sent by you.

Resume Database

You shall use the Joblooba Resume Database as provided in these Terms. You shall use the Joblooba Resume Database in accordance with all applicable privacy and data protection laws, and You agree You shall not further disclose any of the data from Joblooba Resume Database to any third party, unless You are authorised to do so.

You shall take appropriate physical, technical, and administrative measures to protect the data You have obtained from the Joblooba Resume Database from loss, misuse, unauthorised access, disclosure, alteration or destruction.

The Joblooba Resume Database shall not be used:

i) For any purpose other than as an employer seeking employees, including but not limited to advertising promotions, products, or services to any Resume holders; or

ii) To make unsolicited mail, email or phone calls, to Resume holders or to contact any individuals unless they have agreed to be contacted; or

iii) For any other purpose other than that specified in these Terms and in the Privacy Policy.

In order to ensure a safe and effective experience for all users, Joblooba reserves the right to limit the amount of data that may be accessed by You in any given time period without incurring liability.

Additional Terms Applicable To Job Seekers

When you register with the Joblooba Website, You will be asked to create an account and provide us with certain information .

Any Profile You submit must be accurate and describe You, an individual person. The Profile requires standard fields to be completed.

You acknowledge and agree that You are solely responsible for the form, content and accuracy of any Resume or material contained therein placed by You on the Website.

You understand and acknowledge that You have no ownership rights in Your account and that if You cancel Your Joblooba account or Your Joblooba account is terminated, all Your account information from Joblooba, including Resumes, Profiles, cover letters, saved jobs may be deleted from Joblooba’s databases and will be removed from any public area of the Joblooba Website. Information may continue to be available for some period of time because of delays in propagating such deletion through Joblooba’s web servers. In addition, third parties may retain saved copies of Your Information.

6. Links To Other Websites

This Website contains links to other websites on the Internet which are owned and/or operated by third parties. We do not accept any responsibility for or liability in respect of the content of those websites, the owners of such websites do not necessarily have any connection, commercial or otherwise, with us. Using automatic links to gain access to such websites is entirely at your own risk. If you believe there to be any links on our Website which do not adhere to these Terms or to our Privacy Policy please email us at admin@joblooba.com and we will investigate.

7. Content On This Website

We have taken every care in the preparation of the content of this Website, some of the information is supplied to us by third parties and we are not able to check the accuracy or completeness of that information. We will try to resolve any errors on the Website as soon as we are reasonably able to. However, we do not accept any liability arising from any inaccuracy or omission in any of the information on our Website or any liability in respect of information on the Website supplied by you, any other website User or any other person.

8. Your Use Of This Website

You may only use the Website for lawful purposes when seeking employment or help with your career or when recruiting staff. You must not under any circumstances seek to undermine the security of the Website or any information submitted to or available through it. In particular, but without limitation, you must not seek to access, alter or delete any information which you do not have authorised access to, seek to overload the system via spamming or flooding, take any action or use of any device, routine or software crash, delay, damage or otherwise interfere with the operation of the Website or attempt to decipher, disassemble or modify any of the software, coding or information comprised on the Website.

Joblooba’s Website is for your non-commercial use only. If you wish to make commercial use of the Website, or if you wish to purchase any Joblooba services that utilise the Website, you must have a prior written agreement with Joblooba to do so, or have accepted Joblooba’s online Terms and Conditions. We reserve the right at all times (but will not have any obligation) to terminate users, and reclaim usernames, for any reason.

9. User Content

You understand that all information, data, text, images, audio, video, messages or other materials submitted, posted or displayed by You on or through the Joblooba Website (herein referred to as “User Content”) is the sole responsibility of the person from which such User Content has originated. Such functionality is designed to help users obtain career and company information, facilitate communication, discuss ways to make career decisions, and to let users know of jobs. Joblooba claim no ownership or control over any User Content. You or a third party licensor, as appropriate, retain all patent, trademark and copyright to any User Content you submit, post or display on or through Joblooba and you are responsible for protecting these rights, as appropriate. By submitting, posting or displaying User Content on or through the Website, you grant Joblooba a worldwide, non-exclusive, royalty-free, transferable, sub-licensable license to use, reproduce, adapt, distribute and publish such User Content through Joblooba. In addition, by submitting, posting or displaying User Content which is intended to be available to the general public, you grant Joblooba a worldwide, non-exclusive, royalty-free license to reproduce, adapt, distribute and publish such User Content for the purpose of promoting Joblooba and its services. Joblooba reserves the right to refuse to accept, post, display or transmit any User Content at its sole discretion. User Content is provided by third-party contributors, many of whom may use anonymous screen names. User Content may be inaccurate, incomplete, misleading or deceptive. Joblooba does not endorse and is not responsible for any User Content, including any opinion, advice, information, or statement. You acknowledge that by accessing the Website, you may come into contact with content (including User Content) that you find harmful, offensive, threatening, indecent or objectionable, including, but not limited to, explicit language and other potentially offensive material, and you agree and acknowledge that Joblooba shall have no liability with respect to such content. You permit any User to access, display, view, store and reproduce such User Content for personal use. Subject to the foregoing, the owner of such User Content placed on the Website retains any and all rights that may exist in such User Content. Joblooba may review and remove any User Content that, in its sole judgment, violates these Terms, violates applicable laws, rules or regulations, is abusive, disruptive, offensive or illegal, or violates the rights of, or harms or threatens the safety of, Users of any Joblooba Website. Joblooba reserves the right to expel Users and prevent their further access to the Website for violating the Terms or applicable laws, rules or regulations. Joblooba may take any action with respect to User Content that it deems necessary or appropriate in its sole discretion if it believes that such User Content could create liability for Joblooba, damage Joblooba’s brand or public image, or cause Joblooba to lose Users or (in whole or in part) the services of its ISPs or other suppliers.

You must not post any User Content that is unlawful, fraudulent, discriminatory, threatening, abusive, libellous, defamatory, obscene or otherwise objectionable, or that contains sexual, ethnic, racial or other discriminating slurs, or that contains no relevant or constructive content. You must also not post any User Content that contains proprietary information, trade secrets, confidential information, advertisements, solicitations, chain letters, pyramid schemes, investment opportunities, or other unsolicited commercial communication (except as otherwise expressly permitted by Joblooba in writing), or encourages or causes spamming, flooding or phishing. Furthermore, You must not post content that contains restricted or password only access pages, or hidden pages or images. Also that solicits passwords or personal identifying information from other Users.

You are prohibited from posting any User Content containing official identification information (whether your own or of another person), including, but not limited to, social security numbers, passport numbers, national identification numbers, insurance numbers. Posting such identification information may lead to identity theft and other adverse consequences. Joblooba may remove any such identification information, but does not undertake any obligation to do so, and has no responsibility and disclaims all liability for any posting of such identification information. Joblooba reserves the right to change the display of Resume on its Website, including, but not limited to, hiding fields, rearranging its format, and changing visual elements.

Joblooba reserves the right to disclose all User Content and other relevant information, and the circumstances surrounding their transmission, to any third party in connection with operating the Website; to protect itself, its affiliates, its partners and its visitors; and to comply with legal obligations or governmental requests.

Without limiting the generality of the foregoing, Joblooba reserves the right (but is under no obligation) to remove any Job Listing that directly or indirectly discriminates against Job Seekers.

10. Use of Our Website and Our Relationship with You

These Terms shall be governed under English law. By accepting these Terms we each agree to submit to the exclusive jurisdiction of the English Courts for the determination of disputes.

11. Data Protection And Privacy

We use and process your personal information in accordance with our Privacy Policy.

12. Limitation Of Liability

Joblooba acts as, among other things, a venue for, employers to post job opportunities and search for and evaluate job candidates and for candidates to post Resumes and Profiles and search for and evaluate job opportunities. The material contained on the Website and in the Services is for information purposes only, Joblooba does not screen or censor the listings, including Profiles offered. You are responsible to carry out any due diligence of any information on the Website and in the Services and use your own judgement before doing anything on the basis of what you see. Unless expressly stated in writing by us or required by law, we give no warranties of any kind in relation to the materials on the Website and in the Services. Joblooba does not control or is involved in, the actual transaction between employers and candidates. As a result, we are not responsible for User Content, the quality, safety or legality of the jobs or Resumes posted, the truth or accuracy of the listings, the ability of employers to offer job opportunities to candidates or the ability of candidates to fill job openings and Joblooba makes no representations about any jobs, Resumes or User Content on the Website. While Joblooba reserves the right in its sole discretion to remove User Content, job postings, Resumes or other material from the Website from time to time, we do not assume any obligation to do so and to the fullest extent permitted by law, disclaims any liability for failing to take any such action.

You understand that there are risks, including but not limited to the risk of physical harm, of dealing with strangers, underage persons or people acting under false pretences. You assume all risks associated with dealing with other users with whom You come in contact through the Website. By its very nature other people’s information may be offensive, harmful or inaccurate, and in some cases will be mislabelled or deceptively labelled. We expect that You will use caution and common sense when using the Website. Joblooba disclaims any liability in relation to this.

Joblooba cannot and does not confirm that each User is who they claim to be, as we are not involved in User-to-User dealings or control the behaviour of participants on the Website, in the event that You have a dispute with one or more Users, You release Joblooba (and our agents and employees) from claims, demands and damages (actual and consequential and direct and indirect) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes to the fullest extent permitted by law.

The Joblooba Website and the content may contain inaccuracies or typographical errors. Joblooba makes no representations about the accuracy, reliability, completeness, or timeliness of any Joblooba Website or the content. The use of the Website and the content is at Your own risk. Changes are periodically made to the Website and may be made at any time. Joblooba cannot guarantee and does not promise any specific results from use of the Website. No advice or information, whether oral or written, obtained by a User from Joblooba or through or from the Website shall create any warranty not expressly stated herein.

We are not liable for any action you may take as a result of relying on any information/materials provided on the Website and in the Services or for any loss or damage suffered by you as a result of you taking such action; or any dealings you have with third parties (e.g. other users or advertisers) that take place using or facilitated by the Website and Services; or any liability for losses which are not a foreseeable or likely consequence of  your use of the Website and Services.

We are not responsible if you cannot use the Website and Services properly or at all because of any event outside our control (e.g. the performance of your or our internet service provider, your browser or the internet).

The Website and Services rely in part on software to work. Whilst we monitor the Website and Services and try to fix bugs promptly, we do not guarantee that the Website and Services will be error free, available all the time and/or free from viruses. Joblooba disclaims any liability which may arise as a result of this.

Nothing in these Terms affects any liability which we may have for death or personal injury arising from our negligence, fraud or any other liability which cannot be excluded or limited by law.

Joblooba does not provide or make any representation as to the quality or nature of any of the third party products or services purchased through any Joblooba Website, or any other representation, warranty or guarantee. Any such undertaking, representation, warranty or guaranty would be furnished solely by the provider of such third party products or services, under the terms agreed to by the provider.

We may terminate your registration and/or deny you access to the Website or any part of it (including any services, goods or information available on or through the Website) at any time in our absolute discretion and without any explanation or notification.

14. Choice Of Law And Jurisdiction

These Terms are governed by English law. The courts of England are to have exclusive jurisdiction to settle any dispute arising out of or in connection with the use of the Website or any agreement made through the Website.

Some of the goods or services offered through the Website may not be lawful or may otherwise not be permitted in certain countries outside the United Kingdom. If you attempt to order, receive, purchase or otherwise benefit from any such goods or services, we do not accept any liability for any losses suffered by you in using the Website which you would not have suffered had you been accessing the Website as a United Kingdom resident (including as a result of us being prevented from dealing with any application or enquiry by any law, regulation or other ruling applicable in any country).
